Welcome to Garys Party Rentals. By accessing our website (www.garyspartyrental.com) and booking our services, you agree to comply with and be bound by the following terms and conditions.

2. BOOKINGS & DEPOSITS

  • All reservations are subject to availability and are only confirmed once the required non-refundable deposit is paid.

  • The remaining balance must be paid in full prior to or at the time of delivery, as specified in your invoice.

3. DAMAGE POLICY & EQUIPMENT CARE

The Renter is responsible for all equipment from the time of delivery until pickup. In the event of damage, one of the following three protocols will apply:

  1. Damage Waiver: An optional, non-refundable fee that covers minor, accidental wear and tear. This does not cover gross negligence, theft, or damage caused by prohibited items (e.g., Silly String, face paint).

  2. Professional Repair: For repairable damage, the Renter agrees to pay the total cost invoiced by a third-party professional repair company, including logistics and shipping.

  3. Total Replacement: If the equipment is deemed unrepairable, suffers permanent aesthetic damage (stains, cuts, chemical burns), or is lost/stolen, the Renter is responsible for the full current market replacement cost of a new unit.

4. GEORGIA SAFETY & WEATHER COMPLIANCE

  • Child Safety: Constant adult supervision (18+ years) is strictly required for all inflables and interactive games.

  • Weather Policy: In compliance with Georgia safety standards, Garys Party Rentals reserves the right to cancel or deflate equipment if winds exceed 15-20 mph or if lightning/heavy rain is present.

  • Silly String Warning: Silly String causes permanent chemical damage to vinyl. If detected, the Total Replacement fee will be automatically applied.

5. SPECIALIZED EQUIPMENT (MECHANICAL BULL & LUXURY FURNITURE)

  • Mechanical Bull: This is a high-risk activity. The Renter acknowledges inherent risks and agrees that only individuals in proper physical condition (not under the influence of alcohol or drugs) may participate.

  • Throne Chairs & Candy Carts: These items are for decorative/photographic use only. Do not move these items once installed by our staff. Any upholstery stains or structural damage will be billed under the Professional Repair or Replacement protocols.

  • Tents: The Renter must ensure all underground utility lines are marked before staking. Cooking under tents is strictly prohibited.

6. LIABILITY RELEASE (GEORGIA STATE LAW)

PLEASE READ CAREFULLY: By hiring Garys Party Rentals, the Renter hereby releases, waives, and discharges Garys Party Rentals, its owners, and employees from any and all liability for injury, disability, or death, or loss or damage to person or property, whether arising from the negligence of the releasees or otherwise, to the fullest extent permitted by the laws of the State of Georgia.

7. GOVERNING LAW

These terms shall be governed by and construed in accordance with the laws of the State of Georgia. Any legal actions must be filed in the courts presiding over the business’s primary location.

8. CANCELLATION & REFUND POLICY

  • Deposits: All deposits paid to Garys Party Rentals are non-refundable. This deposit secures your equipment and date, making it unavailable to other customers.

  • Standard Cancellations:  Cancellations made more than [7 days]  prior to the event date will result in a credit of the deposit amount, valid for a future rental within [6 months].

    • Cancellations made within [48 hours] of the event date will result in the forfeiture of the deposit and may be subject to a cancellation fee of 20% of the total rental balance.

  • Weather-Related Cancellations:  Garys Party Rentals reserves the sole right to cancel an installation if weather conditions in Georgia (winds over 15-20 mph, heavy rain, or lightning) are deemed unsafe.

    • In the event of a weather-related cancellation before setup, the customer will receive a full credit of the deposit toward a future date.

    • Once the equipment is set up and installed, no refunds or credits will be issued due to subsequent weather changes.

  • No-Show Policy: If the Renter is not present at the delivery location at the agreed time, or if the setup area is not ready/accessible, the driver will wait for 15 minutes before moving to the next delivery. In this case, the rental will be considered canceled, and the full balance will be charged.
